A New Jersey family thinks that they've hit the jackpot by finding some porn on the PG movie that they rented from Blockbuster. Working for a locally-owned video store, you might think that I would be happy to see Blockbuster in such trouble; that would be completely untrue.
The family claims that their 4 year-old watched the explicit sex scenes that had been recorded on the tape (after the credits) and Blockbuster must pay for the damage done. First, I would doubt that there was any real damage done. Kids find out about sex in all sorts of ways; and, I admit, this one was pretty unfortunate, but I doubt the child is going to be scarred for life. Second, the suit claims that Blockbuster must be responsible for what is on all of the tapes that they rent out...
that means that they would have to watch all of the tapes that are returned (through the credits and until the tape ends) each day, before they could rent them out again. This is an unbelievable and impossible burden to place on the store and other customers. Every video store would have to hire someone to do nothing else but watch these videos before each one was returned to the shelves! I suppose the stores could raise the rental rates to $10 to help cover the costs, but I don't think the customers would accept that price hike for the protection from offensive images.
Nor would the customers accept the extended wait for the newest releases, while all the returns were reviewed for tampering. It is an unfeasible expectation for Blockbuster to provide such precautions so that your child won't have to ask questions about sex at an earlier age than you had hoped.
This family should get a years worth of free rentals and maybe the child should get a nice collection of children's movies (factory fresh and unopened) for the unfortunate incident... nothing more. As it is, thousands of other families will now record porn on the ends of their rental tapes and hope they can cash in too.
People are far too greedy and eager to extort money from big companies in an effort to get rich quick. There are so many devastating and deserving lawsuits out there that need to be heard by judges that are busy sorting through crapsuits like this one.
